Alfred Stadem's Last Will and Testament,

Note: This Last Will and Testment was drawn up November 27, 1948, a year after the deaths of son Arthur Stadem and son-in-law Robert Ginther. Alfred Stadem lived another sixteen years. There is no surprises in it, and the wording is probably the customary kind. However, Alfred Stadem meant the opening words most soberly and sincerely, to be sure, as all those who knew him knew he did nothing except he was assured it was in the will of God and in the name of God. For him those were not mere terms of legalese, they were a life a God-fearing man should always strive to live before God and man.

The signs were paid for with memorial gifts at the funerals.

How different from today's church and secular culture, where the fear of God is such a rarety, and Gospel Signs, once numerous, are a sight all but vanished from the American landscape.--Ed.

IN THE NAME OF GOD, AMEN, I, Alf, J. P. Stadem, of the Town of Bryant, P. O., in the County of Hamlin and State of South Dakota, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last will and testament.

First, I order and direct that my executrix hereinafter named, pay all my just debts and funeral expenses as soon after my decease as conveniently may be.

Second, after payment of such funeral expenses and debts, I give, devise and bequeath unto my beloved wife, Bergit Stadem, all and singular the property of which I die seized and possessed, both real and personal, and wherever same may be situate, but in case my said wife does not survive me, then I give, devise and bequeath all and singular the property of which I die seized and possessed, both real and personal, to my children, share and share alike, namely, Pearl Ginther, Cora Taylor, Myrtle Svanoe, Bernice Schaeffer, Estelle Rangen, Alida Spilde, Ruth Stadem and LeRoy Stadem, and in case my wife does not survive me and any or either of said children do not survive me, then the share of such child or children not surviving shall go to any surviving issue by right of representaton and if there be no issue but there be a surviving spouse then to such surviving spouse. Naturally the omission to provide for my children except in case my wife does not survive me is intentional.

Third, I hereby authorize and empower my Executrix hereinafter named, to sell or mortgage any or all of the property of which I may die seized and possessed, at private sale or public auction as to her may seem best, without first procuring any order to mortgage or order of sale therefore,and without the necessity of giving any notice of sale, subject only to confirmation by the Court having jurisdiction of my estate.

Fourth, it is my request that my Executrix hereinafter named be appointed without being required to give any bond, and in case of any mortgage or sale of the property of my estate, that she likewise be required not to give any bond.

Fifth, in case of the inability or refusal of my wife, Bergit Stadem, hereinafter named as execurix of my estate, to set as such executrix, then I hereby make, constitute and appoint LeRoy Stadem, my son, to be Executor of my said estate, to have the same power and authority as given to my Executrix hereinbefore, and to be appointed without the necessity of giving any bond on his original appointment and without the necessity of giving any bond in case of mortgaage or sale of any property of my estate, except as may be ordered and directed by the Court having jurisdiction of the probating of my estate.

Lastly, I make, constitute and appoint Bergit Stadem with no bonds, to be executrix of this, my Last Will and Testament, hereby revoking all former Wills by me made.

IN TESTIMONY WHEREOF, I have hereunto subscribed my name and affixed my seal the 27th day of November, in the year of Our Lord, One Thousand Nine Hundred Forty-Eight.

THIS INSTRUMENT was, on the day of the date thereof, signed, published and declared by the said testator, Alf. J. P. Stadem, to be his Last Will and Testament, in our presence, who, at his request, have subscribed our names thereto as witnesses in his presence, and in the presence of each other.

Ruth Stadem Harrington with Alfred's future son-in-law Tom Harrington, who would buy back the farm after its sale by son Leroy Stadem, restoring it for possible retirement and also for use as yearly Stadem family reunions.
